Police to Increase Evidence Collection During DUI Stops

In 2015, the Arizona Supreme Court settled a controversial question of law involving the admissibility of evidence collected from unreliable testing machines. More specifically, the case centered around whether the state could admit evidence of driver intoxication if the method of obtaining that evidence involved a testing machine with a history of inaccurate results. Ultimately, the court decided that the state could admit such evidence, but that criminal defense attorneys could also present the jury with rebuttal evidence to show that the DUI results may - or may not - be entirely accurate.
